Yes. The claimed misuse transaction and the transaction to return OP tokens can be verified on chain.
Additional evidence comes from the acknowledgement of misuse from CEO of Via protocol @serafim:- “I acknowledge that the decision to use a portion of the OP tokens as collateral on Sonne to generate yield was made with the intent to increase available funds for refunding gas fees to Optimism users. This decision was made without the intention of violating the initial grant conditions. All proceeds were transferred back to the multisig wallet.”
